Acceptance of Terms

By accessing or using Colvesta (the "App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use Colvesta.

About Colvesta

Colvesta is a collector showcase platform that allows users to display their personal collections, explore other collectors' collections, and connect with a community of enthusiasts. Colvesta is not a marketplace. We do not facilitate the buying, selling, or trading of any items. Any transactions that may occur between users are entirely outside the scope of our Service, and Colvesta bears no responsibility for them.

Eligibility

You must be at least 13 years of age to use Colvesta. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

User Accounts

4.1Account Creation

You may sign in to Colvesta using third-party authentication providers such as Google or Apple. By doing so, you authorize us to access certain account information from those providers in accordance with their respective terms.

4.2Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately at support@colvesta.com if you suspect any unauthorized use of your account.

4.3Accurate Information

You agree to provide accurate and truthful information when setting up your profile and collection entries.

User Content

5.1Your Content

Colvesta allows you to upload images, descriptions, and other content related to your collections ("User Content"). You retain ownership of any intellectual property rights you hold in that content.

5.2License to Colvesta

By uploading User Content, you grant Colvesta a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.

5.3Content Standards

You agree not to post content that:

• Is false, misleading, or deceptive
• Infringes on any third party's intellectual property or privacy rights
• Contains hate speech, harassment, or violent material
• Promotes illegal activity
• Is sexually explicit or inappropriate

Colvesta reserves the right to remove any content that violates these standards, without prior notice.

Collection Valuations

Colvesta may display estimated market values for items in your collection as an informational metric. These valuations are approximate, sourced from third-party data providers, and are provided for reference purposes only. They do not constitute financial advice or a guarantee of actual market value. Colvesta is not responsible for decisions made based on these estimates.

Pro Tier and Payments

Colvesta offers a free tier and a paid Pro tier with additional features. If you subscribe to the Pro tier:

• Payments are processed through the App Store (Apple) or Google Play and are subject to their respective billing terms.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are handled according to the policies of the platform through which you purchased (Apple or Google).

Colvesta reserves the right to modify pricing or features of any tier at any time, with reasonable notice to existing subscribers.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service or another user's account
• Scrape, crawl, or extract data from the Service without written permission
• Impersonate any person or entity
• Use the Service to spam or harass other users
• Interfere with or disrupt the integrity or performance of the Service

Intellectual Property

All content, features, and functionality of Colvesta — including but not limited to the logo, design, text, graphics, and software — are the exclusive property of Colvesta and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Third-Party Services

Colvesta integrates with third-party services (such as authentication providers and market data sources). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of such services is governed by their respective terms.

Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Colvesta does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

As Colvesta is currently in a pre-launch development phase, features may change, be unavailable, or be discontinued at any time.

Limitation of Liability

To the fullest extent permitted by applicable law, Colvesta and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — the Service.

Termination

We reserve the right to suspend or terminate your access to Colvesta at any time, for any reason, including violation of these Terms, without prior notice or liability.

You may stop using the Service at any time. If you wish to delete your account, you may do so through the app settings.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Guatemala, without regard to its conflict of law provisions.
